This website is owned and operated by Universal Fashion Philippines Inc. and these Terms and Conditions apply to visitors and users of Hollister. The term “We” refers to Hollister, the provider of this website and “You” as a user who accepts these Terms and Conditions. If you do not agree to these Terms and Conditions, please refrain from using this website.

Eligibility

As a user and to place an order within Hollister, you must be at least 17 (seventeen) years of age. If you are under 17 (seventeen) years of age, you must only place an order with Hollister with the consent and involvement of your parent or guardian. If you do not have consent and involvement from your parent or guardian, you must stop using the site.

You agree that all information and personal data provided to Hollister through website, email, telephone, or other forms of communication is truly yours and not obtained from personal information belonging to third parties without legal permission. TERMS OF SALE

Product Information

All material and information relating to products presented by Hollister is intended to be used for personal educational or informational purposes only.
All products should be used strictly in accordance with their instructions, precautions, and guidelines.
Product image as seen on the Hollister may slightly differ from the actual product that you receive. There may be a 1-2cm difference in measurements depending on the development and manufacturing process. Actual colors may also vary. This is due to the fact that every computer monitor has a different capability to display color thus we cannot guarantee that the color you see accurately portrays the true color of the product.
Whilst we make the best efforts to ensure that all details, descriptions, and prices which appear on Hollister are accurate, we do not warrant that the descriptions, colors, information, pricing, promotions or other content available on the website is accurate, current or free from error. Hollister may correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the website is inaccurate at any time without prior notice, including after you have submitted your order.

Placing Order

To place an order, you must submit your information to us which is accurate and true. You must also keep your information up to date by informing us of any changes.
To submit an order, you will be required to follow the online shopping process on Hollister. After that you will receive an order confirmation/invoice which will act as an acknowledgement of your order.
Whilst we make the best efforts to ensure that all details, descriptions, and prices which appear on Hollister are accurate, there may be instances where errors may occur. If we discover an error in the price of any products which you have ordered, we will inform you of this and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel your order before we have shipped it to you and you have already paid for your order, you will receive a full refund.
We are under no obligation to fulfill your order if the price listed on Hollister is incorrect.
To minimize the risk of unauthorized access, we encrypt your card data. Once we receive your order, we will request pre-authorization on your card to ensure sufficient funds are available to complete the transaction. Order will not be confirmed until this pre-authorization check has been completed. Your card will be debited once we have sent you the order confirmation. Cards are subject to validation checks and authorization by card issuer. If we do not receive the required authorization, we will not be liable for any delay or non-delivery.
Upon authorization of the payment, by clicking the “Place Order” button you are confirming that you have reviewed your order (product color, size, quantity (as relevant)), that the card belongs to you and that you have sufficient funds or credit facilities to cover the cost of your order.
We reserve the right to withdraw any products from Hollister at any time and/or remove or edit any materials or content on Hollister. We will make our best efforts to always process all orders but there may be exceptional circumstances wherein, we may need to refuse to process an order after we have sent you the order confirmation/invoice, which we reserve the right to do at any time, at our sole discretion.
We will not be liable to you or any other third party by reason of our withdrawing any product from Hollister whether it has been sold or not, removing or editing any materials or contents on Hollister or for refusing to process or accept an order.
Payment Method

Hollister accommodates several payment methods to ease your shopping experience. The payments methods available are:

• Bank Transfer – Virtual Account

Bank Transfer (Automatic Confirmation) or Virtual Account (VA) is bank transfer method using a unique virtual account number that will be issued once you finish the transaction process. The number will be different for each order.

Advantages of using Virtual account:

Easy & practical – Automatic confirmation by system, and the order will be processed immediately once payment is completed.
Make sure to make the payment by 1x24 hours from the time of order confirmation to avoid automatic cancellations by our system.

• Credit Card

You can use your Mastercard, Visa and JCB credit card for payment. You need to input your card details on Checkout page. The required data you need to input are:

16 digits of card number.
Card’s expiry date.
CVV Numbers: 3 digits of confidential numbers on the back of the card. Orders that use a different name than stated on the card will be cancelled by the system as fraud prevention mechanism.

Delivery

We aim to deliver the product to you at the place of delivery stated in your order.
We will attempt to notify you if there is a delay in delivery, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.
We deliver in our standard packaging. You acknowledge that the products are standard and not made bespoke to fit any particular requirements that you may have.
CLICK and COLLECT Hollister allows you to choose CLICK and COLLECT service, where you can shop on our website and collect the products at a store of your choice. Guides on CLICK and COLLECT:

You can choose CLICK and COLLECT service during the shipment detail process where you will need to select the store you wish to collect your order from.
We will send your collection code by Email to the registered Email ID once your order is ready to be collected.
You can collect the products only after receiving the collection code by Email. Show the code to our Cashier to complete the process. If you lose your collection code, please contact our Customer Service Team and we can help you to resend it.
CLICK and COLLECT method can only be selected if all the products are available from one single location.

Return Policy

Criterias

Product purchased at full price and with a maximum of 30% discount. We do not accept returns for products which have been purchased at more than 30% discount during promotion period
Product must have never been used and must still be in its original condition, complete with labels attached to the product and without damage.
Product must has no stains, broken seams, missing buttons, loosened threads or other conditions that deem the product to be defective or damaged.
Products must have its brand box and packaging in its original condition. The box and packaging must not be broken or dented, not attached to any adhesive material, and complete with other items from the original packaging such as cartons, clothes hangers, stickers, ribbons, ropes, polybags, plastic, and other objects.
Request for product return must be made within 7 (seven) days of when the order is received. Returned products must be received at the pre-determined location no later than 7 (seven) days after the date of return is approved by Hollister.
When returning the product, please use the outer/packaging box as we sent you and cover the product packaging with a sturdy wrapper and add a “FRAGILE” sticker to the shipment to damage on the original box during shipment. We do not accept any form of returns where there is damage to the product and the product packaging/box.
Refund process takes 7 (seven) to 14 (fourteen) working days. It may vary depending on the refund method. Refund will be made as soon as we have received the returned products and according to your initial payment method selected during puchase. We do not refund the shipping costs of returned products

Exchange Policy

We do not support exchange of the products but you may return your product for a full refund (provided the exchanged product meets the criteria) and place a new order.

Exceptions

Due to health and sanitary considerations, return requests do not apply specifically to swimwear, sports bras, sportswear, tights (including tights/leggings, compression/compression pants, cycling shorts), socks, fitness equipment, sports accessories (including hats), and other products or brands with specific Terms and Conditions and which have been stated clearly in the description.

Faulty Products

All product descriptions, information, and materials posted on Hollister are provided ‘as is’ and without warranties expressed, implied, or otherwise howsoever arising.
If the product that you receive is faulty, please contact our Customer Service Team and provide us with your order number, name and address, product details, and the reason for return, and an information on a refund or an exchange request.
Upon receipt of the faulty product, we will examine it and advise you on the status of the refund or exchange (if any).
Hollister may at its discretion refuse to process an exchange. However, we may offer a refund as a substitute remedy.
In the event the product returned is not faulty, we may at our discretion decide not to exchange or refund for the product.

Unless stated in these Terms and Conditions or by the applicable law, Hollister does not make any statements, representations, warranties or guarantees, and offers no other conditions, express or implied, about any matter, including but not limited to, the merchantability, suitability, fitness for any specific use or purpose, or non-infringement of Hollister membership, for all content and all products or services available through Hollister as well as implied guarantees from a course of performance or dealing. In certain areas, the law does not permit the disclaimer of guarantees, so the above disclaimer is limited to the extent that the law permits.

Hollister places great value on our customer satisfaction. You may contact us at a designated time using the contact details from the Contact Us. We will attempt to address your concerns and will contact you on receipt of any relevant enquiry or complaint. In the event of a complaint, it will help us if you can describe the object of your complaint as accurately as possible and, where applicable; send us copies of the order or the order number that was sent to you in the order confirmation email.

When you use the website or send emails to Hollister, you are communicating with Hollister electronically. You agree that all agreements, notices, disclosure, and other means of communications sent to you electronically are legally valid as written communications. In the case such events should occur, Hollister may temporarily be unable to deliver the products you have purchased, you will be given the option to delay delivery or cancel the purchase and receive a refund.

No failure or delay by us or you in exercising any right under these Terms and Conditions shall operate as a waiver of such right or extend to or affect any other or subsequent event or impair any rights or remedies in respect of it or in any way modify or diminish our or your rights under these Terms and Conditions.

Assignment

You may not assign these Terms and Conditions (or any rights, benefits or obligations) by operation of the law, or otherwise, without the prior written consent of Hollister, which may be withheld at Hollister’s discretion. Any attempted assignment that does not comply with these Terms and Conditions shall be null and void. Hollister may assign these Terms and Conditions, in whole or in part, to any third party at its discretion.

Severability

If any clause in these Terms and Conditions shall become or shall be declared by any court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall in no way affect any other clause or part of any clause. This Privacy Policy governs how Hollister, a premium apparel retailer owned by Universal Fashion Philippines Inc. (“Hollister” or “HCo” or “us” or “we”) handles information and personal data from users of Hollister and sites, mobile applications, services, and customers of our stores and webstores. (“User” or “you”) means users of our sites, mobile applications, services, and customers of our stores and webstores. The terms (“personal data” or “personal information”) refer to information, data or a combination of data that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you, and includes personal data or similar terms as defined in applicable law.

Hollister respects your concerns about privacy and commits to protect the security of your personal data. This Privacy Policy describes the basis, terms and conditions that apply to the acquisition, collection, processing, analysis, storage, updating, display, announcement, delivery, dissemination, disclosure, and/or opening of access, deletion and destruction associated with the information and personal data provided by User to us and data collected by Hollister from User either when User register as customers, access our sites, use mobile applications, makes a purchase at our stores or webstores and/or use services provided by us.

Information We Collect

We may obtain personal information about you from various sources, including when you use, access and/or create an account at Hollister sites and mobile applications, when you visit or make a purchase at our stores and webstores, when you communicate and interact with us through phone, email, or social media, from our group companies (i.e, parent, affiliate or subsidiary companies), business partners and other third parties who have permission to share your personal data with us.

The types of information and personal data that we collect include, but are not limited to:

Contact information (e.g., name, address, e-mail address, and telephone number).
Individual identification information (e.g., date of birth, age, gender,).
Photograph (for example when you submit for a contest or join our events).
Banking information (e.g., debit card, credit card, bank account details).
Record of your contact with us (e.g., records of your calls, live chat features, emails or letters sent, or other records of any contact with us).
Credential information (e.g., security information used for authentication and access to accounts and services).

How We Use Your Information

We may use the information we obtain from you to:

Register you as a user/to create your account, and manage and maintain your account on our sites.

In addition to the above, we and our service providers may use the information collected through cookies, beacon, pixel tags and other automated means to automatically collect certain information when you use our sites, mobile applications, visit and shop at our website (e.g., to enable you to identify the electronic shopping basket you may create on our sites and enable you to retrieve shopping baskets you previously created). We may combine the information we collect with publicly available information and information we receive from our parent, affiliate or subsidiary companies, business partners and other third parties. Our legal basis for collecting and using personal information will depend on the personal information concerned and the specific context in which the information is collected.

We need personal information in order to fulfill a contract with you, where we have a legal obligation to do so or where it is in our legitimate interests to carry out the processing (such as processing for administrative purposes, direct marketing, service improvement, fraud or criminal action prevention and support information security) and not to the exclusion of your data protection interests or fundamental rights and freedoms. If we ask you to provide personal information to comply with legal requirements or to fulfill a contract with you, we will explain this at the time of collection of the information. We will also tell you whether the requirements for the information are mandatory and explain any consequences to you if you do not provide the information.

Universal Fashion Philippines Inc. is the data controller of all personal information collected, unless otherwise stated in an additional privacy notice.

Online Advertising

On our websites, we may collect information about your online activities to provide advertising about products and services tailored to your individual interests. You may see certain ads on this site and other sites because we participate in advertising networks. Ad networks allow us to target our advertising to users through demographic, behavioral and contextual means. These networks track your online activities over time by collecting information through automated means, including through the use of cookies, web server logs, web beacons and other methods. The networks use this information to show you advertisements for Hollister and our business partners that are tailored to your individual interests. The information our ad network vendors collect includes information about your visits to websites that participate in the vendors’ advertising networks, such as the pages or advertisements you have viewed, and the actions you take on the sites. This data collection and ad targeting take place both on our websites and on third-party websites that participate in the ad networks. This process also helps us track the effectiveness of our marketing efforts.

Information We Share

We do not sell or otherwise disclose personal information about you, except such disclosures in manners and to the party as described in this Privacy Policy. We may share the personal information we collect from you and about you:

with our parent, affiliate and subsidiary companies for management, analysis, and operational purposes
to our business partners (including brand’s principals), third party providers who assist with order fulfillment and other operational services, network vendors and their participants, and other third parties to the extent the disclosure is required to enable them to perform a business, professional, or technical support function for us

If we transfer your information outside the jurisdiction of Philippines, we will ensure that your information is properly protected. We will always ensure that the country where the third party is based has a level of protection of personal data that is equivalent to or higher than Philippines, or the third party who will receive your personal data has adequate and binding standards of protection for personal data. If these standards are not met, we will implement additional safeguards or obtain your explicit consent before proceeding.

Storage and Retention

We will store and retain your personal data for as long as reasonably needed or permitted for the purpose(s) for which it was obtained.

Personal data we collected are stored in electronic format. We store your data in data centers managed either by us or by service providers on our behalf. All of our facilities and systems are equipped with the necessary security controls to ensure the protection of personal data.

We may retain your personal data to provide the services you have requested, or for other important purposes, such as complying with our legal obligations, resolving disputes and implementing our policies. Retention periods can vary significantly based on the type of information and how it is used. Our retention periods are based on criteria that include mandatory retention periods based on prevailing laws and regulations, pending or potential litigation or investigation, requirements under agreements/contracts, operational directives or needs, and historical archiving. When the retention period is over, we will delete your personal information from our system by using appropriate security protocols so that it cannot be reconstructed or read.

We are not responsible for the content of any websites not affiliated with Hollister, any use of those sites, or those sites’ privacy practices.

How We Protect Personal Information

We maintain administrative, technical and physical safeguards designed to assist us in protecting the personal information we collect against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. For example, we use Secure Sockets Layer encryption to protect certain of your purchase information while in transit. Please note that no electronic transmission of information can be entirely secure. We cannot guarantee that the security measures we have in place to safeguard personal information will never be defeated or fail, or that those measures will always be sufficient or effective. We will notify you in writing if we find any failure to protect data confidentiality. To further protect yourself, you should safeguard your Hollister account username and password and not share that information with anyone. You should also sign out of your account and close your browser window when you have finished your visit to our sites. Please note that we will never ask for your Hollister account username or password via email.

Age Limit

Hollister does not sell its products to anyone we know to be under the age of 17 (seventeen). We require registered users of the site to be at least 17 (seventeen) years old. As a user and to place an order within hollister.id, you must be at least 17 (seventeen) years of age. If you are under the age of 17 (seventeen), you must only place an order with hollister.id with the consent and involvement of your parent or guardian. If you do not have consent and involvement from your parent or guardian, you must stop using the site.

Updates to this Privacy Policy

This Privacy Policy may be updated periodically to reflect changes in our data processing practices and changes in regulatory requirements, without prior notice to you. Users are expected to read carefully and check this Privacy Policy page from time to time to find out any changes made by us to this Privacy Policy.
